BACKGROUND:

Contingent Rights are a key element of free movement of persons (Article 12) and provide the general and social rights that OECS citizens and their family members are entitled to when exercising the right to free movement within the Economic Union.

The OECS Contingent Rights Model Bill, which strengthens the implementation of these rights, will be tabled for adoption at the next regular meeting of the OECS Authority in June 2026. Thereafter, there will be a national enactment of the Model Bill. The OECS Commission is set to host a series of webinar discussions that highlight key features of contingent rights and their implications for ordinary citizens.

Each discussion will focus on a particular theme, using a central idea to illustrate how contingent rights allow for free movement benefits for citizens of Protocol Member States (and their third-country spouse and dependents) with respect to indefinite stay, employment, and doing business within Protocol Member States.

The Organisation of Eastern Caribbean States (OECS) is an International Organisation dedicated to economic harmonisation and integration, protection of human and legal rights, and the encouragement of good governance among independent and non-independent countries in the Eastern Caribbean. The OECS came into being on June 18th 1981, when seven Eastern Caribbean countries signed a treaty agreeing to cooperate with each other while promoting unity and solidarity among its Members. The Treaty became known as the Treaty of Basseterre, so named in honour of the capital city of St. Kitts and Nevis where it was signed. The OECS today, currently has twelve members, spread across the Eastern Caribbean comprising Antigua and Barbuda, Commonwealth of Dominica, Grenada, Montserrat, St. Kitts and Nevis, Saint Lucia, St Vincent and The Grenadines, British Virgin Islands, Anguilla, Martinique, Guadeloupe and Saint Martin.
